Fulfillment Policy

The following terms and conditions (the "Agreement") administers the use of the coachinginstruments.com website and services (“Services”) advertised and available on or at the coachinginstruments.com website (the "Website").

The Website is owned and operated by Peter Balyta LLC ("Peter Balyta LLC"). The Website is offered subject to your (the "User" or "you") acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be modified and published from time to time on the Website by Peter Balyta LLC – including, Pricing, Refund, Privacy Policy and others.

If you do not agree to this Agreement, please refrain from using the Website.

Peter Balyta LLC offers a refund policy adhering to the policies mentioned.

1. Access & User Information

In order to purchase services on the Website, the User may fill the contact form on the Website (including filling out all required personal information). The User must notify Peter Balyta LLC immediately of any breach of security or unauthorized use of its account.

Peter Balyta LLC may change, suspend or discontinue the Services, Products, fees, charges and terms at any time, including the availability of any feature or content. Peter Balyta LLC may also impose limits on certain features and Services or restrict User's access to parts or all of the Services without notice or liability. The User certifies to Peter Balyta LLC that if the User is an individual (i.e., not a corporation), the User is at least 18 years of age. The User also certifies that it is legally permitted to use the Website, and takes full responsibility for the selection and use of the Website. This Agreement is void where prohibited by law, and the right to access the Website is revoked in such jurisdictions.

2. Modifications

Peter Balyta LLC reserves the right, at its discretion, to modify this Agreement, fees, charges and terms at any time. The User shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Website by the User following such notification constitutes the User's acceptance of the changes in the terms and conditions.

3. Payments and Fees

Peter Balyta LLC may save User’s credit or debit card information, unless the User notifies Peter Balyta LLC otherwise through an email to [email protected]

By accepting this Agreement, the User is confirming that it is legally entitled to use the means of payment tendered and, in the case of card payments, that the User is either the cardholder or have the cardholder's express permission to utilize the card to effect payment. Peter Balyta LLC may refuse to process a transaction for any reason or refuse Service to anyone at any time at Peter Balyta LLC's sole discretion. Peter Balyta LLC will not be liable to User or any third party by reason of refusing or suspending any transaction after processing has begun.

Unless stated otherwise, all fees and payments are quoted in the U.S. Dollars. The User is responsible for paying all fees, payments and applicable taxes associated with our Website and Services.

4. Online Payment Security

Peter Balyta LLC uses the secure Kajabi Payments for its online credit card transactions. All online credit card transactions performed on this site are secured payments.

Payments are fully automated with an immediate response.

Your complete credit card number cannot be viewed by Peter Balyta LLC or any outside party.

All transactions are performed under 128 Bit SSL Certificate.

All transaction data is encrypted for storage within bank-grade data centres, further protecting your credit card data.

5. Refund, Cancellation & Scheduling Policy

Our refund and scheduling policy is designed to be clear and fair to both you and us. Please see below for more details regarding refunds for each product and service type.

Executive Coaching

Refund & Cancellation Policy

Non-Refundable First Month
Your first month’s payment is non-refundable. This covers your weekly coaching sessions for the first month, reserved immediately upon purchase.
Notice to Cancel
You may cancel your coaching subscription at any time with 30 days’ written notice. Your 30-day cancellation window begins the day we receive your notice. Any scheduled payments that fall within that window will still process.
Commitment Terms & Early Cancellation
Selecting a 3-month, 6-month, or 12-month term provides a discounted monthly rate. If you cancel before completing your chosen term:

All completed months will be retroactively billed at the standard month-to-month rate, and
You will be charged the difference between the discounted rate and the standard rate for each completed month.

This adjustment is billed at the end of your 30-day cancellation window.
No refunds will be issued for unused or partially used months.

No Refunds for Coaching Delivered or Offered
Any session that has been delivered, or reasonably offered (including no-shows), is non-refundable.

Scheduling & Session Policy

Weekly Session Access
Your subscription provides one weekly coaching session. You may schedule sessions through our online scheduling software or coordinate directly with your coach.
Rescheduling by the Client
You may reschedule a session using the online calendar, provided the change is made at least 24 hours in advance.
No-Show / Late Cancellation Policy
If you miss a session or cancel with less than 24 hours’ notice, the session is counted as used and is not eligible for rescheduling or refund.
Rescheduling by the Coach
If your coach must reschedule a session, you will receive a full replacement session at no additional charge. A “weekly credit” will be applied to ensure you do not lose the value of that week’s coaching.

Consulting

The Discovery Call is free and exploratory only. All consulting work is custom and requires a signed agreement outlining scope, timeline, and fees. No consulting begins and no fees are incurred until both parties approve a written contract.

All Self-Guided Courses

Including, but not limited to: Leadership Development, Land Your Dream Job, Fast Track to Impact, MiniMBA, Expat, and Classroom to Boardroom courses such as Beyond the Classroom and Land Your Dream Job.

14-Day Money-Back Guarantee

Coaching Instruments stands behind the quality of our programs. If the course is not the right fit, you may request a full refund within your first 14 days of enrollment.

How to Request a Refund

To initiate a refund, you must:

Submit your request in writing to [email protected]
Include a brief explanation of why the course was not a fit
Meet all eligibility criteria outlined below

Requests not submitted in writing or received after the 14-day window will not be accepted.

Eligibility Requirements

To qualify for a refund:

You must have completed 10% or less of the course content
Progress is measured by platform data (including lessons viewed, modules marked complete, files downloaded, and/or time-based analytics)

Non-Refundable When Threshold Is Exceeded

The money-back guarantee is void if:

You have completed more than 10% of the course,
You have downloaded or accessed proprietary materials in a manner that reflects active use of the program beyond initial evaluation, as supported by course activity data, or
Your request is submitted after the 14-day window

After the 14-day period closes, all payments are non-refundable, and you retain access for the full duration of your 12-month enrollment.

All Group Coaching Sessions

Including but not limited to Leadership Development, Classroom to Boardroom, Triathlon & Endurance, Running & Endurance.

Membership is billed on a monthly basis and remains active until cancelled in accordance with the terms below.

Billing, Cancellation, and Refunds

Membership fees are charged monthly and are non-refundable, including charges incurred during the 30-day cancellation period.

Cancellation Requirement: Members may cancel their membership at any time with 30 days’ written notice. The cancellation is effective 30 days from the date the written notice is received by Coaching Instruments.

Access to live sessions, community features, and course content continues until the effective cancellation date.

No Partial Refunds. Coaching Instruments does not provide partial-month refunds, prorated refunds, or credits for unused sessions, including sessions not attended by the member.

Attendance and Session Delivery

Attendance at live group sessions is encouraged but not required. If a member is unable to attend a group session, the session is considered forfeited. Missed sessions do not roll over, accrue, or convert into credits, refunds, or rescheduled appointments.

Session Recordings. Coaching Instruments may provide access to session recordings for active members. Availability of recordings is not guaranteed and may vary at the company’s discretion. Access to recordings ends upon cancellation of membership.

Coach-Initiated Changes

If a coach must cancel or reschedule a session, Coaching Instruments will either:

Provide a rescheduled session at no additional cost, or
Apply a session credit to the member’s account.

This ensures members receive the full value of the weekly coaching allotment.

(Optional) Self-Guided Course Access and Refund Terms

All rules, restrictions, and eligibility criteria outlined in the Self-Guided Courses Refund Policy apply to course access within the Group Coaching Membership.

General Refund Process

After we receive your request, we will process it accordingly.

Please allow at least five (5) business days from the receipt of your request to process your refund. Refunds may take an additional 5 days to appear on your credit card statement, depending on your credit card company.

Please note: If a student is found plagiarizing me, my content, or anything in the course it is grounds for immediate dismissal without a refund.

6. General

No agency, partnership, joint venture, employee-employer, relationship, etc. is intended or created by this Agreement. You acknowledge that you have all the necessary permits to grant us with User’s personal data to fulfill this Agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. In our sole discretion, we may assign this Agreement upon notice to you. Headings are for reference purposes only and do not limit the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. We do not guarantee that we will take action against all breaches of this Agreement.

General Provisions

Coaching Instruments reserves the right to update or modify program elements (including session format, coach assignments, or content delivery methods) with appropriate notice, provided such changes do not materially diminish the value of the membership.
